Terms and Conditions

1. Interpretation

1.1 The following definitions apply to the Terms and Conditions set out in this document:
Parent
A parent or legal guardian who will be responsible for the payment of the Fees and who is the contracting party to this contract and the person / persons who attend the course or any part of it, with the child
Child
The child who has been signed up to attend the classes
Coach
The person who teaches the class
Venue
Where the class takes place
Terms
The terms and conditions set out in this document
Writing or Written
Does include e-mail correspondence

1.2 These Terms shall be governed by English Law and shall fall under English jurisdiction.

2. Acceptance

2.1 All agreements relating to the teaching of the classes by Roarsome Sport to the Child are subject to these Terms to the exclusion of all other terms and conditions.

2.2 No variation or addition to the Terms shall be binding unless agreed in writing by Roarsome Sport.

2.3 These Terms shall be deemed to be accepted by the Parent once the box is ticked at point of booking on the website or the booking form.

3. Payment

3.1 The Parent must pay for class fees by monthly subscription, by half term blocks or per single session in advance of the Child attending the classes.

3.2 Any refund of class fees is discretionary. Once classes have started it is not normal to offer any refund. A paid 3 week trial or a free 1 week trial is offered to every Child before signing up to a subscription to ensure the Parent and Child wish to commit.

 

 

4. Cancellation

4.1 Roarsome Sport reserves the right to close a class for any reason whatsoever. In the event of classes being permanently cancelled by Roarsome Sport, we will refund class fees to the Parent for the remaining classes if alternative classes are not suitable.

4.2 Roarsome Sport does not offer refunds for classes cancelled by a Parent.

4.3 In the event that the Coach cancels a class due to illness you will be offered an alternative session which you are able to attend up to 6 months after the date of the cancellation.

4.4 In the event of a force majeure e.g. disruption resulting from extreme weather conditions, strikes, terrorist activity, or where local authorities/public guidance advise that classes should be temporarily suspended for health or other reasons no refunds will be given and you will be offered alternative sessions which you are able to attend up to 6 months after the date of the cancellation.

5. Parent’s Obligations

5.1 The information supplied on the booking form is accurate and up to date and that if any of this information changes Roarsome Sport is immediately notified.

5.2 The Child is deemed to be under the direction, care and control of the Parent throughout the classes and the Parent is also responsible for the welfare and conduct of the Child for the duration of the classes and whilst the Child is as the Venue.

6. Limitations of Liability

6.1 Roarsome Sport takes all reasonable care in ensuring that programmes are safe. However, the Parent agrees that their Child will be participating in physical activities that may involve some risk of injury. The Parent should seek medical advice with respect to any past or present injury, illness, health problem or any other condition or medication that may affect their Child’s participation.

6.2 Roarsome Sport takes no responsibility whatsoever for any loss, damage or expense incurred by a Child and/or Parent whilst participating in a class or whilst at the Venue where a class is taking place.

6.3 In the event that Roarsome Sport determines the behaviour of the Child and/or Parent to be unacceptable, Roarsome Sport is within its rights to exclude the Child and the Parent from the classes.

6.4 The Parent agrees that any claim against Roarsome Sport or any Coach or employee, must be brought within 60 days of the event that gave rise to such claim.
